Domain Registration Agreement
The registrant of a domain (any W3DATA customer who purchases a .com or .net domain, hereafter referred to as "the Domain Registrant") agrees to abide by the following terms and conditions:
1. Prohibited Activities
The Domain Registrant must not use the domain for any of the following activities:
- Distributing malware or operating forms of abuse such as botnets, phishing, or pharming.
- Engaging in piracy, trademark, or copyright infringement.
- Involvement in fraudulent or deceptive practices, counterfeiting, or any other criminal activity.
Consequences: If a domain is used in violation of these terms, W3DATA reserves the right to suspend the domain's registration.
2. Registry Rights and Responsibilities
Verisign, the Registry Operator, reserves the right to:
- Deny, cancel, redirect, or transfer any registration or transaction.
- Place domains on lock, hold, or similar status at its sole discretion for reasons such as:
- Compliance with internet standards or industry specifications (e.g., RFCs).
- Correcting errors made during registration.
- Protecting against threats to registry or internet stability and security.
- Ensuring compliance with applicable laws, regulations, or court orders.
- Enforcing terms and conditions under agreements with ICANN or the Domain Registrant.
3. Indemnification
The Domain Registrant agrees to indemnify, defend, and hold harmless:
- The Registry Operator (Verisign, Inc.), ICANN, and their affiliates.
- W3DATA, its officers, employees, and agents.
This indemnification covers all claims, damages, liabilities, and expenses, including reasonable legal fees, arising from domain registration or usage.
4. Accurate and Reliable Contact Information
The Domain Registrant is required to:
4.1 Provide accurate and reliable contact details, including:
- Full name, postal address, email, and phone number.
- Administrative and technical contact details.
- Primary and secondary nameserver information.
4.2 Update this information within seven (7) days of any changes.
4.3 Failure to comply may result in suspension or cancellation of the domain registration.
5. Third-Party Licensing
If the Domain Registrant licenses the domain to a third party:
- The Domain Registrant remains responsible for maintaining accurate contact details.
- Liability for harm caused by misuse of the domain will rest with the Domain Registrant unless they provide contact details and the identity of the licensee within seven (7) days of a legitimate request.
6. Data Processing and Protection
W3DATA will process registrant data in accordance with applicable data protection laws and ICANN requirements.
6.1 Registrants will be informed about:
- The purposes and recipients of their data.
- Which data is mandatory and which is voluntary.
- Their rights to access and rectify their data.
6.2 W3DATA will take reasonable precautions to protect registrant data from unauthorized access, loss, or misuse.
7. Legal Compliance
The Domain Registrant warrants that their domain registration and usage do not infringe on the rights of third parties. Registrants must comply with:

8. Jurisdiction and Dispute Resolution
The Domain Registrant agrees to submit to the jurisdiction of:
- The courts of their domicile.
- The jurisdiction where W3DATA is located.
